Preservationists have filed a federal suit to halt the administration’s bid to tint the Lincoln Memorial Reflecting Pool American flag blue. The lawsuit, filed May 11, targets the Department of the Interior and the National Park Service, demanding a temporary restraining order.

The 2,030‑foot‑long, 170‑foot‑wide basin has long served as a neutral mirror, a visual anchor on the National Mall. Altering its hue would, experts argue, erase the reflective quality that earned the site its place on the National Register of Historic Places.

Legal backdrop

Section 106 of the National Historic Preservation Act obliges agencies to consult stakeholders before any alteration to a listed property. Charles A. Birnbaum, president of the Cultural Landscape Foundation, says the administration “has skipped the consultation step entirely.”

“A blue‑tinted basin belongs in a resort, not a monument,” Birnbaum told Reuters.

The foundation seeks a preliminary injunction to stop work already underway. Critics note this is not the first alleged Section 106 breach by the administration, citing disputes over the Eisenhower Executive Office Building and a proposed state ballroom in the White House East Wing.

Beyond the legal fight, the controversy reflects a broader tension between executive aesthetic whims and historic preservation norms—a debate that has intensified since the pandemic era, when public‑space stewardship became a flashpoint.
