Mail-in Voting Court Ruling: Immediate Implications

The mail-in voting court ruling issued by U.S. District Judge Indira Talwani on June 25 halted the Postal Service from refusing ballots in states that balk at a federal voter list. “The Constitution reserves voter eligibility to the States alone,” the judge wrote, citing the 10th Amendment.

“The Constitution does not grant the President any specific powers over elections,” Talwani added, noting her appointment by former President Obama.

The injunction targets an executive order from March that demanded the USPS restrict ballot delivery unless states submitted a federally‑approved roster of voters. ↓ 23 states, led by a coalition of swing‑state attorneys general, sued and won, forcing the administration to retreat for now. Reuters reported that the Postal Service had prepared to withhold millions of ballots in non‑compliant states, a move critics called an attempt to tilt the upcoming midterms. In a Senate hearing on June 24, Postmaster General David Steiner acknowledged the plan but said the courts would decide its fate. Election analysts warn that any future challenge could create uncertainty for millions of voters, especially in states that rely heavily on universal vote‑by‑mail systems such as Oregon, Colorado and Washington. The ruling arrives weeks before the November ballot, setting the stage for a legal battle that could echo through the 2024 presidential contest.
