Apple filed an emergency petition with the U.S. Supreme Court, urging a stay on the pending App Store fee calculation while it seeks review of the district court’s contempt order. Without a stay, the company says it would be forced to disclose proprietary pricing data and endure irreversible damage to its business model.

The dispute traces back to a 2021 injunction that required Apple to allow developers to link to alternative payment systems. Apple complied, but continued to charge a fee ↓ 3% below its standard rate, prompting a contempt finding.

“The injunction should apply only to Epic Games, not the entire developer ecosystem,” Apple argued in recent filings.

Potential market impact

Regulators in Europe and Asia are monitoring the case, fearing that any court‑mandated fee could reshape global app economics. A stay would preserve Apple’s current zero‑fee link‑out structure, letting U.S. developers continue to avoid charges while the Supreme Court decides whether to hear the broader appeal.

Should the Court deny the stay, the district court is slated to issue a fee figure on May 5. Reuters and Bloomberg note that the outcome could ripple through markets tied to digital payments, even influencing sectors as distant as nuclear technology financing.
