The Senate Homeland Security and Governmental Affairs Committee voted Thursday to hold Dr. Anthony Fauci in contempt of Congress after he invoked the Fifth Amendment more than 100 times during a heated hearing on the pandemic response.

Fauci contempt of Congress: procedural fallout

Republican chair Rand Paul argued that Fauci’s pardon from former President Joe Biden does not shield him from answering questions, while Democrats warned the resolution is largely symbolic.

“The vote is largely symbolic, because the full Senate would have to approve to hold Fauci in contempt,” said former U.S. attorney Barbara McQuade to Reuters.

The 8-7 vote (↓ 1) now heads to the full Senate, where a ↑ 60 vote is needed to break a filibuster and certify the contempt charge for the Department of Justice.

Potential penalties if convicted

A conviction could bring a fine of up to $100,000 and up to one year in prison, though prosecutors must prove willful defiance—a hurdle many legal analysts deem high.

Paul announced he will bypass the full‑senate vote and hand‑deliver the resolution to the DOJ, a move legal scholars call “theatrical” but within his rights.

Legal experts from AP News note that the Biden pardon covers alleged crimes through Jan. 19 2025, yet the Fifth Amendment protection against self‑incrimination remains intact for any future perjury risk.

Should the case linger, a future Democratic administration could drop the prosecution, a strategy some advisers suggest might be Fauci’s best bet.
