Musk Altman lawsuit: the courtroom showdown in Oakland

The clash that began Monday in a federal courtroom pits Tesla chief Elon Musk against OpenAI leader Sam Altman over a claim worth ↑ $130 billion. Musk, who contributed roughly ↓ $38 million to OpenAI’s seed round, alleges that Altman and co‑founder Greg Brockman betrayed the nonprofit’s original charter by spinning off a for‑profit arm now valued near $1 trillion. His objective is not personal compensation but to dismantle the conversion and oust Altman and Brockman.

Legal odds and nonprofit law

Nonprofit scholar Sam Brunson notes that donors rarely succeed in forcing reversals unless fraud is proven. The crux hinges on whether OpenAI promised never to create a for‑profit subsidiary – a promise that, if documented, could tilt the case.

“If I donate to an organization, I’ve given up that money, and if it turns out that I don’t like what they do subsequently, my recourse is to stop donating,” Brunson told Reuters.

Personal stakes and burning questions

The trial will hear from both CEOs, Microsoft’s Satya Nadella and former board member Shivon Zilis, who also mothered four of Musk’s children. Prosecutors may probe Musk’s 2017 Burning Man attendance, hoping to link vague recollections to strategic decisions. Altman, meanwhile, reportedly holds compromising material on Musk, turning the dispute into a public character war. With four weeks on the calendar, the outcome remains uncertain, but the spectacle is already reshaping the narrative around AI governance.
