Justice Samuel Alito countered, likening the dissent to “reading it out loud,” and reminded the bench that both Republican and Democratic presidents have used metering. Federal prosecutors argue that individuals intercepted before crossing are not “arrivals” and therefore not entitled to immediate asylum processing.

The ruling arrives amid a docket of immigration fights, including challenges to birthright citizenship and the recent pandemic-era restrictions. Legal experts note that any revival could swell border queues, which previously stretched into the thousands.

Human‑rights groups, led by Democracy Forward, condemned the judgment, warning that a hardening of the border will “surely result in many more lives lost.” The case underscores a broader clash between the courts and an administration eager to tighten entry rules.
