NYC Mayor Mamdani Says He Can’t Arrest Netanyahu – Legal Limits Exposed

Can NYC Enforce an arrest Netanyahu Warrant?

In a video posted to X on July 21, 2026, New York City Mayor Zohran Mamdani conceded that his administration lacks the legal authority to arrest Netanyahu should the Israeli prime minister set foot in the city. “Our review of every applicable statute shows we cannot execute the ICC warrant independently,” Mamdani said.

“The federal government holds that power, and I call on it to act,” he added, echoing his earlier plea to Washington.

The mayor’s statement follows months of rhetoric promising to detain the Israeli leader during the September UN General Assembly. Legal scholars note the United States is not a party to the Rome Statute, and the American Servicemembers Protection Act of 2002 bars local police from cooperating with ICC processes.

Critics, including New York Attorney General Letitia James, have warned that Mamdani’s threats could breach state law. Reuters reported that diplomatic immunity under the UN Headquarters Agreement would likely shield Netanyahu.

The mayor’s office budget grew ↑ 5% this fiscal year, but that increase does not translate into jurisdictional clout. Meanwhile, President Donald Trump reiterated on Truth Social that AP News covered his denial that any U.S. authority will detain the Israeli premier.

Even as the city debates its stance, the broader debate over the International Criminal Court’s reach persists, a conversation that resurfaced during the recent pandemic discourse on global governance.
