NAACP sues xAI over illegal data‑center turbines – Clean Air Act showdown

NAACP sues xAI over unpermitted turbines at Memphis data center

The civil‑rights group has filed a complaint in the U.S. District Court for the Northern District of Mississippi, alleging that Elon Musk’s AI venture xAI and its affiliate MZX Tech are operating ↓ 27 methane‑fuel gas turbines without an air‑quality permit to power the Colossus 2 facility in South Memphis. Violation of the Clean Air Act is the core of the case, which seeks an injunction to shut the turbines, civil penalties and a court declaration of non‑compliance.

The turbines spew nitrogen oxides, carbon monoxide and fine particulate matter—pollutants linked to cardiovascular disease and respiratory ailments. Residents living within a half‑mile radius have complained for months, describing the plume as a “health hazard.” Environmental lawyers from the Southern Environmental Law Center and Earthjustice represent the NAACP, noting that xAI ignored a 60‑day notice of intent to sue, a procedural step required by the Act.

“Operating a private power plant without permit is not only illegal, it is an affront to the families who breathe the same air,” said Ben Grillot, senior attorney for the Southern Environmental Law Center.

Data‑center operators across the sector are scrambling for power solutions. While Google, Meta and Amazon have inked nuclear supply contracts, xAI appears to rely on on‑site gas generation, a strategy reminiscent of Oracle’s recent moves. Critics argue that the rush to build bespoke power sources undercuts the Reuters‑cited goal of reducing carbon footprints in the AI boom.
