In a move that could land the tech mogul in criminal court, a bipartisan Wisconsin Elections Commission panel found probable cause that Elon Musk violated state election bribery statutes by posting on X that he would hand out $1 million checks to voters who participated in the 2025 Supreme Court race.

The six‑member commission, split evenly between Democrats and Republicans, voted 5‑1 in a closed session to forward two sealed complaints from Milwaukee and Green Bay to the Brown County district attorney. Under state law, prosecutors have ↓ 40 days to inform the commission of a decision.

Scale of the giveaway

Musk’s America PAC poured ↑ $20 million into the contest, backing Republican former Attorney General Brad Schimel, who ultimately lost to Democrat Susan Crawford, preserving the court’s liberal tilt. Two separate checks of $1 million each were presented at a Brown County rally on March 30, 2025, just hours before the April 1 vote.

“The offer was limited to individuals who had voted in the Supreme Court election,” the commission’s statement read.

Earlier, Wisconsin Attorney General Josh Kaul sued to block the giveaways, arguing they constituted illegal bribery. A state court denied an injunction, and the Wisconsin Supreme Court dismissed Kaul’s emergency petition without comment.

Legal scholars note the case tests the boundary between political speech and election fraud, a debate resurfacing after the pandemic era’s surge in campaign finance scrutiny.
