Why Voters Are Shifting

Gallup finds seven in ten Americans oppose a data center in their neighborhood, a sentiment stronger than opposition to nuclear plants. PJM attributes ↓ 63% of the 2025‑26 capacity price surge to data center load, translating to roughly $9.3 billion recovered from ratepayers across 13 states and pushing household bills up ↑ 1.5% this summer.

“We must do a much better job working with the communities,” Nvidia CEO Jensen Huang told investors this week.

Yet the fiscal upside is tangible. In Loudoun County, Virginia—dubbed the “Data Center Capital of the World”—the sector contributes ↑ 31% of local revenue, funding a $119.7 million stabilization reserve.

State and Federal Countermeasures

New York has paused large data‑center permits for a year pending a statewide study; Texas ordered an audit of every grid‑queue project; Maine’s legislature voted a moratorium that Governor Janet Mills vetoed in favor of an advisory council.

At the federal level, a July 2025 executive order accelerated permitting, while a December preemption order preserved state authority over AI compute infrastructure, per Reuters.

Across the country, 27 states advanced large‑load legislation, with California, Ohio and Utah exceeding the White House’s voluntary ratepayer pledge.

Blueprint for Community‑First Deals

Industry leaders such as Meta and Amazon have pledged to cover full grid costs, echoing the White House pledge signed by seven firms. Meta’s recent $1 billion community fund includes road upgrades, creek restoration and school grants, echoing a pandemic-era push for transparent public investment.

Effective frameworks share four pillars: binding community compacts before permits, proportional infrastructure demands, enforceable security via letters of credit, and statewide baseline floors to prevent regulatory arbitrage.

When localities demand transparent agreements, as Lancaster, Pennsylvania did by publishing its full contract and securing a letter of credit, trust improves and projects move forward without hidden clauses.

As the AI race accelerates, data centers could re‑industrialize the United States—provided policymakers and developers lock in enforceable, mutually beneficial terms before neighboring nations seize the advantage.
