Fauci contempt vote escalates as Senate panel acts

On Thursday the Senate Homeland Security Committee voted ↓ 8-5 to hold Dr. Anthony Fauci in contempt after he repeatedly refused to answer questions about the pandemic origins. Rand Paul (R‑KY) announced he will forward the resolution to the Justice Department, setting the stage for a possible prosecution despite a pre‑emptive pardon from the outgoing administration.

Why the move matters

Republicans argue the pardon shields Fauci from criminal liability, but does not excuse a refusal to testify. Paul asserted,

“Dr. Fauci faced no risk of federal prosecution. All he had to do was tell the truth,”

emphasizing that the Fifth Amendment claim is misplaced.

Democrats counter that the contempt referral threatens future oversight, warning that witnesses may cite this action as a pretext for non‑cooperation. Sen. Gary Peters (D‑MI) warned that the vote could “undermine the committee’s ability to gather information”.

New evidence on the table

Sen. Ron Johnson (R‑WI) disclosed that a subcommittee has secured the phone Fauci used throughout the crisis, potentially adding to the already released diary. The development could fuel fresh inquiries into U.S. funding of Chinese research and the debated “gain‑of‑function” experiments.

External observers note the political stakes. Former White House adviser Reuters reported that the episode may be leveraged to energize the Republican base, echoing long‑standing claims of scientific capture by pharmaceutical interests.

The Justice Department has yet to comment on whether it will act on the referral, stating only that it “seriously reviews all congressional referrals.”
