Judges warned that “the case raises profoundly difficult questions about the appropriate military uses of an almost unimaginably powerful new technology,” noting the risk of over‑constrained models failing in critical missions and the danger of unconstrained systems producing erroneous target data.

“Trump and Defense Secretary Pete Hegseth must balance competing risks,” the opinion read, adding that the Secretary acted within the Supply Chain Security Act.

The ruling denies Anthropic’s petition for review and follows an April denial of its emergency stay request. Reuters reported that the decision could set a precedent for future AI procurement disputes, while Bloomberg highlighted potential ripple effects across defense contractors.
