In Victoria, Australia, lawmakers are debating a remote work law that would grant eligible staff a statutory right to work from home ↑ 2 days each week, shifting the onus onto employers to justify refusals.

What the proposed remote work law entails

The bill would move beyond the usual “right to request” model seen in the UK, Ireland and New Zealand, where employers merely have to consider applications. Here, the legislation would treat remote work as a default entitlement, barring employers from denying it without a solid business case.

“If passed, this would be a watershed for workplace flexibility in the Southern Hemisphere,” noted a senior legal analyst.

Critics warn that the measure could clash with constitutional limits on state intervention in employment contracts, while business groups argue it undermines operational flexibility. Bloomberg reports that several Australian corporations have already tightened in‑office mandates after the pandemic.

Globally, the trend is uneven. The UK’s flexible‑working right dates back years, with 2024 reforms extending it to new hires. Ireland’s 2024 statute mirrors that approach, and the EU obliges parents of young children to request flexible arrangements. In contrast, the United States, still anchored in “at‑will” employment, lacks comparable federal protections, as Reuters points out.

Should Victoria’s bill survive the political gauntlet, it could inspire other jurisdictions to codify remote work as a right rather than a perk, reshaping the power balance between corporate policy and legislative action.
